Terms of Service

These terms cover agentika.ca, the Agentika AI CRM (sales.agentika.ca), and the Platform API portal (ai.agentika.ca). See also our Privacy Policy.
Beta access
Agentika AI CRM beta access is manually provisioned and offered "as is" during the beta period. We may accept, pause, suspend, or discontinue beta access when needed to protect the service, customers, sending reputation, or compliance obligations. Beta features may change or be removed without notice.
Acceptable use
Customers are responsible for using Agentika lawfully, respecting do-not-contact requests, honoring suppression lists and applicable anti-spam law (e.g. CAN-SPAM, CASL), and reviewing AI-generated drafts before sending or publishing them. You may not use Agentika to send unlawful, deceptive, or abusive communications, to scrape or enrich data in violation of a data source's terms, or to circumvent usage limits, credit metering, or security controls.
AI output
AI output (research, scoring, drafts, discovery results) may be incomplete or inaccurate. Agentika provides controls, evidence, review flows, and approval gates, but customers remain responsible for reviewing and approving outbound communications and for final business decisions made using Agentika's output.
Payment, credits, and refunds
AI CRM plans are billed per the plan terms communicated at activation (currently sales-led, manually provisioned). Platform API plans are billed via Stripe on a recurring basis and include a monthly credit allowance; unused credits do not roll over unless stated otherwise. Fees are non-refundable except where required by law or expressly stated at time of purchase. We may suspend access for non-payment after reasonable notice. Manual portal credits (free trial) have no cash value and cannot be redeemed for currency.
Your content and data
You retain ownership of the business and prospect data you provide to or generate within Agentika. You grant us a license to process that data solely to provide and improve the service to you, consistent with our Privacy Policy. You represent that you have the right to provide the data you upload or connect (including any imported lead lists or connected mailbox/calendar accounts).
Termination
You may stop using Agentika at any time. We may suspend or terminate access for breach of these terms, non-payment, suspected abuse, or risk to platform or sender reputation, with notice where practical. On termination, we may retain data for a limited period as described in our Privacy Policy before deleting it.
Disclaimers and limitation of liability
Agentika is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. To the maximum extent permitted by law, Agentika and its affiliates are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or revenue, arising from your use of the service. Our aggregate liability for any claim is limited to the amount you paid us in the twelve months preceding the claim.
Governing law
These terms are governed by the laws of Agentika's jurisdiction of incorporation, without regard to conflict-of-laws principles, unless a signed order form or enterprise agreement with your organization specifies otherwise. Contact hello@agentika.ca for the current jurisdiction and venue applicable to your account.
Changes to these terms
We may update these terms as the product evolves. Material changes will be reflected by updating the "Last updated" date above, and where appropriate we will notify active customers directly. Continued use of Agentika after a change constitutes acceptance of the updated terms.
